USA Today reports....To read Scott's brief, click here.....Here's the comment I left on the USA Today story:....Lt. Xavier Aponte didn't testify.

Tom Harshman didn't testify.

Six credible witnesses who saw Laci walking the morning of December 24th after Scott had left for the Marina, including one neighbor who knew her because they had the same doctor, they did not testify either.

The jurors who were defense-friendly were removed from the jury. The jury that deliberated was actually the fourth version of the jury that had been seated after three jurors were removed, two during deliberations---and yes, the media played a role. In particular the media got Justin Falconer kicked off the jury because Nancy Grace made up a bunch of bs about something he supposedly said, and it played on TV all weekend even though it wasn't true.

Also, tv outlets broadcast, over and over again, "evidence" leaks that were absolute fictions, like the blood on the mop and Scott Just Bought Life Insurance.

For a REAL look at the case get Matt Dalton's book, or go to pwc-sii.com, or my blog, California Vs. Peterson.

If you've always wondered exactly why the guy got convicted, you're not alone. You have good reason to wonder "where's the evidence?" The answer is the police HID evidence. They "lost" evidence turned over to them by Lt. Aponte. They lied to Laci's family about that life insurance.

And Amber Frey got on the stand and testified without ever once telling the jury that she had a book deal that was contingent upon---you guessed it!!

Conviction!!!

__________

Laci Peterson would not approve of the state of my closet.

In fact, I'm pretty sure she'd be appalled. Anyway, it's not too neat right now. And from the non-neatness yesterday morning I pulled my "Scott Peterson Defense Team" T-shirt and thought, OK here it is....and I haven't worn it yet to our new job site in Sherman Oaks. So let's wear it. Then---looking more closely---I decided I didn't want to wear it until it's laundered. But it was funny I pulled it out of the closet yesterday, just funny that it was right there on top of the pile where I'm sure it wasn't the day before. But I do not monitor the piles closely, so I can't say for sure. But it might have been the universe reaching out to remind me of this case. ....

This case blew my mind and served as an introduction to the complications and injustices of the legal system. Since it's such a famous case, followed so obsessively, it's remained a mystery to me why traditional media have shunned the evidence supporting Scott's innocence. In particular, last year I sent the Riverside Press-Enterprise an article and some research I had done summing up the Peterson case, along with links to Marlene's site and supporting documents. I never even had a response from them. And Riverside has a connection to the Peterson case because of what went down at the Norco Correctional Facility, where the evidence "lost" by the MPD originated.

There was no response or interest from the PE. It's clear the information is good because it's sourced from the transcripts and court documents--but, for whatever reason, neither the Press Enterprise nor any other commercial news outlets have aired the other side of the Peterson case, i.e. the numerous problems with it including the excluded evidence and prosecutorial chicanery.

I seem to recall Judge Delucci saying the Norco evidence didn't matter because it came from an inmate.

But it didn't come from an inmate, it came from the head of investigations at Norco, Lt. Xavier Aponte.

Just one thing he got wrong; but it wasn't just wrong, reality was the opposite of what he said.

Seems like the whole thing should be tossed out anyway because of the ravenous gerbils in Judge Delucci's head.
